Proposed amendments to the Workers’ Compensation (Legal Practitioners and Registered Agents) Costs Determination 2015

The Workers’ Compensation (Legal Practitioners and Registered Agents) Costs Determination 2015 (Costs Determination) governs the awarding of legal costs in the Workers’ Compensation Conciliation and Arbitration Services. The Costs Determination is made by the Costs Committee established under s269 of the Workers’ Compensation and Injury Management Act 1981 and approved by the Minister for Commerce.

The Costs Committee has proposed amendments to the Costs Determination. A copy of the Consultation Paper and the Costs Determination with the proposed changes marked in red can be found here.

The Costs Committee is inviting comment from stakeholders on proposed amendments to the Costs Determination. Comment should be limited to issues related to the Costs Determination and should not discuss wider issues relating to the workers’ compensation scheme.

Stakeholder submissions will be considered by the Costs Committee before a final recommendation is made to the Minister.

The closing date for submissions is 19 October 2018.

Submissions will be considered non-confidential, unless a request is made for them to be treated as confidential.
