WorkCover WA Prosecution Function
WorkCover WA regulates employer compliance with the Workers’ Compensation and Injury Management Act 1981 (the Act). Any employer who breaches their legal obligations under the Act is liable to have enforcement action taken against them by WorkCover WA. Breaches of Act are liable to a letter of caution, infringement notice or criminal prosecution.
Previously, when it was determined that a matter should proceed to prosecution, it would progress to the State Solicitor’s Office (SSO) for prosecution management.
As WorkCover WA’s capacity to detect non-compliance has improved, there has been a steady increase in prosecution numbers over the last five years. This has led WorkCover WA to introduce a new in-house Prosecution function from October 2023.
After several weeks shadowing the SSO and becoming familiar with court processes, the Prosecution team will make their first Court appearance on 1 December 2023.
