The Workers Compensation and Injury Management Act 2023 (the Act) is supported by a number of administrative instruments, approved forms and notices, and transitional directives.

The Act and supporting instruments came into operation on 1 July 2024.

Approved forms and instruments must be used from 1 July 2024.

Workers Compensation and Injury Management Act 2023
On 20 March 2024 the Workers Compensation and Injury Management Act 2023 was proclaimed to commence on 1 July 2024.

Workers Compensation and Injury Management Regulations 2024

On 20 March 2024 the Workers Compensation and Injury Management Regulations 2024 were made by the Governor and published on the Western Australian Legislation website.

WorkCover WA Recommended Premium Rates and Industry Classification

WorkCover WA Recommended Premium Rates 2024/25

WorkCover WA determined the WorkCover WA Recommended Premium Rates 2024/25 announced in a Media Statement from the Chief Executive Officer WorkCover WA 28 March 2024.

WorkCover WA’s recommended premium rates for 2024/25 apply to:

  • workers compensation policies issued or renewed under the Workers Compensation and Injury Management Act 2023 with a period of insurance commencing from 1 July 2024
  • employer indemnity policies issued or renewed under the Workers’ Compensation and Injury Management Act 1981 with a period of insurance commencing from 4pm 30 June 2024

WorkCover WA Industry Classification Order

WorkCover made the WorkCover WA Industry Classification Order, effective 1 July 2024.

The WorkCover WA Industry Classification Order provides for the assignment of WorkCover WA premium rating codes (PRCs) to identify an employer’s industry for the purpose of calculating premiums for workers compensation policies.

WorkCover WA Remuneration Guidelines

The WorkCover WA Remuneration Guidelines set out what constitutes ‘remuneration’ to assist employers to provide a remuneration declaration to their insurer when applying for the issue or renewal of a workers compensation insurance policy.

WorkCover WA Permanent Impairment Assessment Guidelines

The WorkCover WA Guidelines for the Evaluation of Permanent Impairment must be used by Approved Permanent Impairment Assessors when assessing the degree of an injured worker’s permanent impairment.

WorkCover WA APIA Approval Criteria

The WorkCover WA approval criteria for APIA sets out the criteria that must be satisfied for the approval of a medical practitioner as a permanent impairment assessor.

WorkCover WA Approved Standards for Performing an Audiological Test

The WorkCover WA Approved Standards for Performing an Audiological Test apply to authorised audiologists performing an audiological test.

Medical Services

The Workers Compensation (Medical Services) Fees Order 2024 (No.2) fixes the maximum amount of compensation payable for a medical expense, incurred or to be incurred, for a medical service as a result of a worker’s injury from employment under the Act.

The Workers Compensation (Health Services) Fees Order 2024 (No.2) fixes the maximum amount of compensation payable for a health expense, incurred or to be incurred, for a health service as a result of a worker’s injury from employment under the Act.

Workplace Rehabilitation Services

The Workers Compensation (Workplace Rehabilitation Services) Fees Order 2024 (No.2) fixes the maximum amount of compensation payable for a workplace rehabilitation expense, incurred or to be incurred, for a workplace rehabilitation service as a result of a worker’s injury from employment under the Act.

Approved Permanent Impairment Assessor Services

The Workers Compensation (Approved Permanent Impairment Assessor) Fees Order 2024 (No.2) fixes scales of fees and charges for permanent impairment assessment services provided by approved permanent impairment assessors under the Act.

Conciliation and Arbitration
Conciliation Service

On 22 May 2024 the Workers Compensation and Injury Management Conciliation Rules 2024 were made by the Director, Conciliation and prescribe matters necessary or convenient for giving effect to the conciliation functions in the Act.

The conciliation service forms are approved by the Director, Conciliation in accordance with the Workers Compensation and Injury Management Conciliation Rules 2024 and are for use in the conciliation of a dispute.

Statement of Social and Financial Circumstances

Costs Determination
